ZKS Defends Component Part Manufacturer in $57 Million Products Liability Claim – Gets Defense Verdict

Andrea Caro, Shareholder and head of the personal injury litigation section of the firm, along with Associate Attorney Shaunda Hill, second chair, received a defense verdict on behalf of their client, a foreign component parts manufacturer after a three-week trial that ended May 2, 2022. Plaintiff sued the component part manufacturer alleging a manufacturing defect, design defect, and negligent failure to warn against the client. In addition to suing the component part manufacturer, Plaintiff also sued the manufacturer of the motorcycle.

On June 16, 2013, Plaintiff, 35 years old at the time of the incident, was involved in a motor vehicle accident while riding a motorcycle after sunset, when an SUV turned in front of him. Plaintiff alleged that the front brake on the motorcycle failed to work properly and was defective which kept him from braking in time to avoid the accident. Further, Plaintiff alleged that Defendant failed to warn him of the risks associated with using the front brake. The component part manufacturer denied the front brake was defective and denied a failure to warn.

In closing arguments, Plaintiff asked the jury to return a verdict totaling over $57 million from both Defendants. The jury deliberated over 2 days and returned a full defense verdict for ZKS’s client.
